Terms & Conditions

1. General

Basically, the "General Terms of Delivery for Machinery and Equipment" ("ALMA") of the Association of Swiss Machine-Industrialists apply. Together with these "General Conditions of Sale and Delivery" ("AVLB"), they form an integral part of all contracts between Th. Zürrer AG ("us") and its buyers.

The currently valid versions are applicable.

Should ALMA and AVLB contradict each other, then the AVLB is authoritative.

Deviating conditions or changes only apply if they have been confirmed by us in writing.

2. Prices

All prices are quoted from our domicile, excluding packaging.

Unless otherwise agreed, our offers are valid for 30 days from the date of issue.

We reserve the right to adjust or cancel our offers at any time.

3. Shipping

Shipping is always at the expense and risk of the buyer. Cash on delivery or other collection charges are at the expense of the buyer.

4. Terms of payment

30 days from the date of issue of the invoice, strictly net.

5. Warranty

For all parts supplied by us, we assume a warranty of 12 months from the date of delivery.

Any defects that are demonstrably due to material or execution errors must be reported to us in writing immediately after their discovery, but no later than five days after receipt of the goods.

The faulty units are to be returned to us for free repair. Costs incurred due to the failure of a unit supplied by us can not be accepted by us.

Shipping costs for the return of the product to be repaired in warranty shall be borne by the buyer. The expenses for the return are borne by us.

Our warranty expires prematurely if the defect is due to independent changes of the buyer.

6. Execution

Measurements on drawings and in catalogs that are not tolerated are considered as a guideline.

Since the constructions are subject to constant improvement, we will always supply the ordered products without any special advance notice according to the latest state of the construction.

7. Cancellation

In case of cancellation of orders by the customer, we are entitled to charge the accrued costs. In the case of immediate cancellation, an additional 10% of the order sum will be due. If the parts are already in production, 100% of the order amount must be paid in addition.

8. Contractual penalty

We do not recognize any contractual penalty.

9. Privacy

We are subject to legal obligations to keep data confidential concerning the business relationship with our buyers ("Customer Data").

The buyer agrees that customer data may be passed on by us to third parties for the fulfillment of our contractual and legal obligations as well as for the protection of legitimate interests.

We also refer to our Privacy Policy.

10. Jurisdiction

Jurisdiction for all disputes is Zurich.
